1.  Institutional Framework and Parties

This workshop is co-organized and hosted by Accademia Europea di Firenze (AEF) S.r.l., legal seat: Via Cavour 37, 50129 Firenze, Italy (VAT / Partita IVA: 05475950480), hereinafter referred to as “AEF” or “Organizer”, and the Lead Artist Fabiano Millani Cassarotti, hereinafter referred to as “Artist”.

By completing the enrollment process and accepting these Terms and Conditions — whether electronically or in writing — the participant (hereinafter “Participant”) enters into a binding contractual agreement with AEF and the Artist. Electronic acceptance has full legal effect pursuant to Article 1326 of the Italian Civil Code and EU Regulation No. 910/2014 (eIDAS).

2.  Enrollment and Payment Terms

  • Total Fee: €620 (six hundred and twenty euros).
  • Confirmation: Enrollment is only confirmed upon receipt of payment. A seat is reserved solely after payment is processed.

Payment Options:

  • Full Payment: €620 at the time of registration.
  • Installment Plan: An initial deposit of 50% (€310) secures the seat. The remaining balance of 50% (€310) must be paid no later than April 4, 2026 (10 days prior to the start date).

Accepted Methods: Credit Card, PayPal, Bank Transfer, or International Postal Order. Detailed instructions: aefirenze.it/en/courses/payment.

Failure to Pay: If the balance is not received by the deadline, AEF will send a written notice to the Participant’s registered email address granting a grace period of 48 hours. Should payment remain outstanding after this period, AEF reserves the right to terminate the enrollment, forfeit the initial deposit, and reallocate the seat without further obligation.

3.  Materials and Facilities

AEF and the Artist will provide all materials required for the workshop, including Rembrandt oil paints, brushes, prepared canvas, and solvents, solely for use during workshop hours. Participants must treat the historic facilities of Palazzo Nicolini with care and respect. Any damage to the premises, fixtures, or equipment caused by a Participant’s negligence or willful misconduct shall be the Participant’s financial responsibility, payable in full upon demand.

4.  Health, Safety, and Environmental Responsibility

Important notice:

This workshop involves the handling of oil-based paints, organic solvents (including mineral spirits and turpentine), and pigments that may contain heavy metals such as cadmium, cobalt, manganese, and chromium compounds. Exposure to these substances without proper precautions may pose risks to health and the environment.

By enrolling, the Participant expressly acknowledges and agrees to the following:

  1. Health Declaration: The Participant declares that they do not have any health condition incompatible with exposure to organic solvents and oil-based pigments, including, but not limited to: severe respiratory conditions (such as asthma or chronic obstructive pulmonary disease), known allergies to any of the materials described herein, or pregnancy. Participants with any such condition are strongly advised to consult a physician before enrolling.
  1. Informed Consent: The Participant acknowledges having received sufficient information about the materials to be used, accepts the inherent risks of the activity, and assumes full personal responsibility for any health effects arising from pre-existing conditions not disclosed to AEF.
  1. Compliance with Safety Instructions: The Participant agrees to strictly follow all safety instructions provided by AEF and the Artist during the workshop, including the proper use of solvents, ventilation of the workspace, and the safe storage of materials during breaks.
  1. Waste and Environmental Compliance: AEF will ensure proper waste disposal in accordance with Italian and EU environmental regulations (EU Directive 2008/98/EC on waste). Participants must not dispose of solvents, pigments, or paint-soaked materials in regular waste receptacles or drains. Specific disposal containers will be provided and identified at the venue.
  1. Fire Safety: The Participant acknowledges that cloths and paper soaked in linseed oil or similar drying oils are spontaneously flammable. Such materials must be placed exclusively in the designated metal containers provided at the venue and must never be folded, compressed, or left unattended.
  1. Removal from Workshop: Any Participant who fails to comply with the safety instructions set forth in this clause, or who poses a risk to the health and safety of others, may be removed from the workshop at the sole discretion of the Artist or AEF, without any right to a refund.

5.  Cancellation and Refund Policy

The following tiered refund policy applies to cancellations initiated by the Participant:

Organizer-Initiated Cancellation: If AEF cancels the workshop for reasons not related to force majeure, a full refund of all amounts paid shall be issued within 14 business days. AEF is not responsible for reimbursement of travel, accommodation, or any other ancillary costs incurred by the Participant.

6.  Force Majeure

AEF shall not be held liable for any failure, delay, cancellation, or modification of the workshop resulting from events beyond its reasonable control, including but not limited to: pandemic or public health emergency, natural disaster, act of God, fire, flood, governmental order or restriction, labor strike, unavailability or closure of the venue, or the death, incapacitating illness, or injury of the Lead Artist.

In the event of force majeure, AEF will notify enrolled Participants as soon as reasonably practicable and will offer, at its discretion, one of the following: (i) rescheduling of the workshop to a new date; or (ii) issuance of a credit note of equivalent value applicable to any future AEF course within 24 months. No monetary refund shall be due under this clause, except where required by mandatory applicable law.

7.  Image and Media Release — Mandatory Consent

Participation in this workshop is conditioned upon the Participant’s prior and express consent to the use of their image and creative work by AEF and the Artist. Participants who do not consent to the terms below may not enroll in this workshop.

By enrolling, the Participant irrevocably authorizes AEF and Fabiano Millani Cassarotti to photograph, film, and record the workshop sessions, including the Participant’s likeness and work-in-progress, and to use such materials for promotional, educational, and institutional purposes. This authorization covers publication across all media platforms currently existing or developed in the future, including, but not limited to: AEF’s official website, social media accounts, printed materials, and educational content. This authorization is granted without geographic limitation, without a fixed time limit, and without any financial compensation to the Participant.

This consent is a material condition of enrollment. If a Participant does not agree to these terms, they must not proceed with registration. AEF will not accept opt-out requests after enrollment has been confirmed.

8.  Privacy and Data Protection (GDPR)

All personal data collected in connection with enrollment and participation in this workshop will be processed by AEF in compliance with EU Regulation 2016/679 (General Data Protection Regulation – GDPR). Data will be used solely for the purposes of workshop administration, communication, and, subject to the consent granted under Section 7, promotional activities. 9.  Limitation of Liability

To the fullest extent permitted by applicable law, the total aggregate liability of AEF and the Artist to any Participant, arising out of or in connection with these Terms and Conditions or the workshop, regardless of the legal basis of the claim (contractual, tortious, or otherwise), shall not exceed the total amount effectively paid by the Participant for the workshop.

AEF and the Artist shall not be liable for any indirect, consequential, or incidental damages, including loss of profits, business interruption, or damages not directly resulting from the workshop itself.

Nothing in this clause shall limit liability for: (i) death or personal injury caused by gross negligence or willful misconduct; or (ii) any other liability that cannot be excluded or limited under mandatory Italian or EU law.

Personal Property: AEF is not liable for loss, theft, or damage to personal belongings brought to the venue. Participants are strongly encouraged to obtain personal health and travel insurance before traveling to Italy.

10.  Governing Law and Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Italian Republic, including, where applicable, the Consumer Code (Legislative Decree No. 206/2005) and the Italian Civil Code.

Any dispute arising out of or in connection with these Terms and Conditions, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Florence (Foro di Firenze), Italy.

Notwithstanding the foregoing, Participants who qualify as consumers under EU law retain the right to bring proceedings before the courts of their country of domicile, as provided by EU Regulation No. 1215/2012 (Brussels I Recast). Participants may also access the EU Online Dispute Resolution platform at: ec.europa.eu/consumers/odr.
